Worso Terms of Service

Version 3 · Effective: 18 October 2026

These Terms of Service ("Terms") are a legal agreement between you and Vladislav Govorukhin, Hlaváčikova 17, Bratislava, Slovakia ("Worso", "we", "us"). They govern your use of the Worso mobile application, the Worso account service and the related application programming interfaces, content and features (together, the "Service").

By creating an account or using the Service you accept these Terms and our Privacy Policy, which explains how we handle your personal data and forms part of these Terms. If you do not agree, do not use the Service.

If you live in the European Economic Area, the United Kingdom or Switzerland, Section 15 gives you additional rights that override anything inconsistent elsewhere in these Terms. If you live in Mexico, Brazil or another country whose consumer laws give you rights we cannot exclude, those rights are not affected by these Terms.

1. What Worso is

Worso is a personal vocabulary-learning tool. You photograph or select an image of printed or written text; the app recognises the text on your device, counts the words it contains and lets you turn individual words into learning cards (translations, forms, examples, usage notes, an optional pronunciation clip and an optional illustration). Cards are produced with the help of third-party artificial-intelligence models (see Section 5). The app also schedules repetition of the words you decide to learn.

Worso is a learning aid. It is not a certified translation service, a dictionary of record, or professional advice of any kind. Learning progress is stored on your device (and, if you choose, in your own iCloud Drive); see the Privacy Policy for what reaches our servers.

2. Eligibility and accounts

2.1 Minimum age. You must be at least 16 years old to use the Service. If you are under 18, you confirm that a parent or legal guardian has reviewed these Terms and agrees to them on your behalf. We do not knowingly allow children under 16 to create accounts; if we learn that we hold an account of a person under 16, we will delete it.

2.2 Account. To use the Service you need an account, created with an email address and password or through Sign in with Google or Sign in with Apple. You agree to provide a valid email address, to keep your credentials confidential and to notify us promptly at dr.vains@gmail.com if you suspect unauthorised use. You are responsible for activity under your account. One person may hold one account; accounts are personal and may not be shared, sold or transferred.

2.3 Deleting your account. You can delete your account at any time from Settings → Subscription → Delete account in the app. Deletion is described in the Privacy Policy. Deleting your account does not cancel an App Store subscription; cancel it in your Apple ID settings (Section 7.4).

3. Licence to use the app

Subject to these Terms we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the Worso app on Apple-branded devices that you own or control, as permitted by the App Store Terms of Service. Your use of the app software is also governed by Apple's Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/); where that agreement and these Terms conflict regarding the Service, these Terms prevail.

We and our licensors own the Service, including its software, design, texts, graphics, prompts, the shared card database and the trademarks "Worso" and the Worso logo. Except for the licence above and the rights in Section 4, nothing in these Terms transfers any rights in the Service to you.

4. Your content and generated cards

4.1 Your content. You keep all rights in the photos you scan and the text recognised from them ("Your Content"). Photos never leave your device. You give us a non-exclusive, worldwide, royalty-free licence to process the individual words you look up and the anonymous word counts described in the Privacy Policy, solely to provide, secure, maintain and improve the Service. You confirm that you have the right to scan the material you photograph for your personal study.

4.2 Generated cards. Learning cards, pronunciation clips, illustrations and word-frequency data ("Generated Content") are produced by the Service for the word you request, not written for you personally. A card for a given word and language pair is stored in a shared cache and is shown, identically, to every user who looks that word up. For this reason we do not assign ownership of Generated Content to you. Instead we grant you a perpetual, non-exclusive, worldwide licence to use Generated Content for your personal, non-commercial learning, including in notes and study materials you make for yourself. You may not use Generated Content in the ways prohibited in Section 6.

4.3 Feedback. If you send us suggestions, bug reports or card corrections, we may use them without obligation to you.

5. Artificial intelligence

5.1 AI-generated content. Generated Content is created by machine-learning models operated by third parties (currently Anthropic, PBC and OpenAI, L.L.C.; see the Privacy Policy for the up-to-date list) in response to the word and language pair you request. You are interacting with an automated system, not with a human translator or teacher.

5.2 Accuracy. Machine-learning models are probabilistic. Generated Content may be incomplete, outdated, offensive or simply wrong, including translations, grammar, example sentences, usage notes, pronunciations and illustrations. Do not rely on Generated Content as your sole source of truth, for exams, official translations, legal, medical or financial matters, or any situation where an error could cause harm. Use the "Report card" function to tell us about a bad card; we may but are not obliged to correct it.

5.3 Word-frequency charts are derived from public text corpora and show how often a word appears in scanned books over time. They are indicative only.

5.4 Changes to models. We may change, add or remove models, model providers and the format of cards at any time, and may regenerate or replace cached cards. We may decline to generate a card or illustration for any word, for example where a model refuses or the word is unsuitable to illustrate.

5.5 No training on your data. We do not use Your Content or your account data to train machine-learning models, and we contract with our model providers on business terms under which your requests are not used to train their models. If this ever changes, we will update the Privacy Policy and ask for your consent where the law requires it.

6. Acceptable use

You agree not to, and not to help anyone else to:

We may investigate suspected violations and may remove content, refuse to generate cards, limit features, or suspend or terminate accounts under Section 8.

7. Free tier, subscriptions and payments

7.1 Free tier. You can use Worso without paying, with a limited daily allowance of scans, card views and words you can mark as learned, and without certain premium features (currently illustrations and card regeneration). The allowances and the feature split are shown in the app and may be changed, reduced or removed by us at any time.

7.2 Worso Premium. Worso Premium is an auto-renewable subscription (monthly or yearly) purchased through Apple's App Store. The exact name, duration and price, including the price after any free trial, are shown on the purchase screen before you confirm. Prices may vary by country and include applicable taxes where the App Store shows them so.

7.3 Billing and renewal. Payment is charged to your Apple ID account when you confirm the purchase. The subscription renews automatically for the same period at the price shown unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the current period ends.

7.4 Cancellation. You can cancel or manage the subscription at any time in your device's Settings → Apple ID → Subscriptions, or via the "Manage subscription" link in the app. Cancellation takes effect at the end of the current paid period; you keep Premium until then. Deleting the app or your Worso account does not cancel the subscription.

7.5 Free trials. A free trial, where offered, is an introductory offer of the App Store: you start the subscription through Apple, nothing is charged during the trial, and unless you cancel before it ends the subscription converts to a paid subscription at the price shown when you started it. Eligibility for introductory offers is determined by Apple, normally once per Apple Account and subscription group.

7.6 Price changes. If we increase the price of a subscription, Apple will notify you in advance and, where required, ask you to agree before the new price applies. If you do not agree, the subscription ends at the end of the current period.

7.7 Refunds. Purchases are made from Apple, and refunds are handled by Apple under the App Store terms. We cannot issue refunds ourselves. To request a refund, go to reportaproblem.apple.com. Nothing in this section limits your statutory rights, including the rights in Section 15 if you live in the EEA, UK or Switzerland.

7.8 Fair-use limits on Premium. Premium removes the daily allowances of the free tier, but it is not unmetered. Generation of cards, illustrations and audio is subject to fair-use limits per account over a rolling window; the current limits and how much of them you have used are shown in the app. We may set, change or remove these limits at any time, including to protect the Service from abuse or excessive cost. Content already generated and cached stays available to you and does not count against these limits. Where a change to the limits materially reduces the core functionality you are paying for, Section 9 applies.

7.9 Entitlement. Your Premium status is determined by the subscription record Apple provides to us. One subscription entitles one Worso account; linking the same subscription to a different account moves the entitlement to that account.

7.10 Discontinuation. If we permanently discontinue the Service or Premium during a paid period, we will refund the pro-rata unused portion through Apple or otherwise as required by law.

8. Suspension and termination

8.1 By you. You may stop using the Service and delete your account at any time (Section 2.3).

8.2 By us. We may suspend or terminate your access, with notice where practicable, if you materially breach these Terms, if we are required to by law, if your use creates risk or legal exposure for us or other users, or if we reasonably suspect fraud or abuse. We may also terminate accounts that have not been used for more than 24 months after giving you at least 30 days' notice by email.

8.3 Effect. On termination your right to use the Service ends and we delete your account as described in the Privacy Policy. Data stored only on your device or in your iCloud Drive is not affected by us. Sections 4.2 (as to already generated content), 6, 10, 11, 12, 14 and 16 survive termination.

9. Changes to the Service

We are continuously developing Worso and may add, change or remove features, languages, models, limits and content. Where a change materially reduces the core functionality you are paying for, we will give you reasonable advance notice and you may cancel your subscription; Section 7.10 applies if we discontinue Premium.

10. Third-party services

The Service depends on services we do not control: Apple (App Store, in-app purchase, Sign in with Apple, iCloud Drive), Google (Sign in with Google), our hosting, email and content-delivery providers and our model providers. Their availability and terms are outside our control, and your use of them is governed by their terms. We are not responsible for third-party services or for content you obtain from them.

11. Disclaimers

The Service and Generated Content are provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure, that Generated Content will be correct, or that the Service will meet your learning goals. This Section does not apply to consumers in the EEA, UK or Switzerland to the extent Section 15 says otherwise.

12. Limitation of liability

To the fullest extent permitted by law:

Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, fraud, or gross negligence or wilful misconduct. Consumers in the EEA, UK and Switzerland: see Section 15.

13. Indemnity

If you use the Service for anything other than personal, non-commercial purposes, you will defend and indemnify us against claims, damages and costs (including reasonable legal fees) arising from that use or from your breach of Section 6. This Section does not apply to consumers where the law does not allow it.

14. Governing law and disputes

14.1 Law. These Terms are governed by the laws of the Slovak Republic, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you also benefit from any mandatory provisions of the law of the country in which you live.

14.2 Talk to us first. If you have a problem, email dr.vains@gmail.com and we will try to resolve it informally within 30 days.

14.3 Courts. Any dispute not resolved informally will be brought in the courts of the Slovak Republic. If you are a consumer, you may also bring proceedings in the courts of the country where you live, and we will bring proceedings against you only there.

14.4 No class actions. To the extent permitted by law, disputes will be resolved individually and not as a plaintiff or class member in any purported class, consolidated or representative action. This paragraph does not apply where it is prohibited, including to consumers in the EEA and UK.

15. Additional terms for consumers in the EEA, United Kingdom and Switzerland

If you are a consumer living in the EEA, the UK or Switzerland, the following applies and overrides anything inconsistent in these Terms:

15.1 Our duty of care. We provide the Service with reasonable skill and care. Digital content and digital services we supply must conform to the contract as required by the law of your country (in the EU, Directive (EU) 2019/770 as implemented locally), and you have the legal remedies that law gives you, including bringing the Service into conformity, a price reduction or termination.

15.2 Liability. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or intent, or for breach of the statutory conformity guarantee. Otherwise we are liable for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill, and we are not liable for loss that is not foreseeable, that is caused by your breach of these Terms, or that relates to a business use. Section 12's monetary cap does not apply to you.

15.3 Right of withdrawal. You have the right to withdraw from a subscription contract within 14 days without giving a reason. Because the subscription is sold through Apple's App Store, the withdrawal right is exercised against Apple under the App Store terms; Apple's refund process at reportaproblem.apple.com is the means to do so, and Apple's terms explain how the 14-day period interacts with immediate access to digital content. You may also use the model form in the Annex and send it to dr.vains@gmail.com; we will assist you with the Apple process.

15.4 Changes to these Terms. For changes that are not purely beneficial to you, we will give you at least 30 days' notice by email or in the app and explain your right to terminate before the change takes effect.

15.5 Language and law. The contract is concluded in English; translations are for convenience. These Terms are governed by the law of the Slovak Republic, but you retain the protection of the mandatory consumer law of your country of residence, and you may sue and be sued in the courts of that country. The European Commission's online dispute-resolution platform was discontinued on 20 July 2025; we are not obliged and do not undertake to participate in alternative dispute resolution proceedings, but you may contact the consumer arbitration body in your country.

16. Changes to these Terms

We may update these Terms. The current version is always available in the app (Settings → Terms of Service) and at https://worso-api.vainslab.cc/legal/terms. For material changes we will notify you at least 30 days in advance by email or by a notice in the app, and the app will ask you to review and accept the new version before you continue using account features. If you do not accept, you may stop using the Service and delete your account; your subscription can be cancelled as described in Section 7.4. Changes required by law or that only add features may take effect immediately.

17. General

17.1 Entire agreement. These Terms, the Privacy Policy and the purchase information shown in the app are the entire agreement between you and us regarding the Service.

17.2 Severability. If a provision is held unenforceable, it will be enforced to the maximum extent permissible and the rest of the Terms remain in effect.

17.3 Assignment. You may not assign these Terms. We may assign them to a successor of our business with notice to you.

17.4 No waiver. Our failure to enforce a provision is not a waiver.

17.5 Export and sanctions. You confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.

17.6 Apple. These Terms are between you and us only, not with Apple Inc. Apple has no obligation to provide maintenance or support for the app and is not responsible for addressing any claims relating to the app or your use of it, including product-liability claims, claims that the app fails to conform to legal or regulatory requirements, consumer-protection claims and intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17.7 Contact. Vladislav Govorukhin, Hlaváčikova 17, Bratislava, Slovakia, dr.vains@gmail.com.

Annex — Model withdrawal form (EEA/UK consumers)

This is a template for you, the customer. Copy it into an email to dr.vains@gmail.com and fill in the blanks only if you wish to withdraw from the contract. Because the subscription is sold by Apple, we will help you route the request through Apple's refund process.
